The App is intended for users aged 17 and older. By using the App, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
We may modify the App or these Terms from time to time. If we make material changes, we may provide notice in the App or by other reasonable means. Continued use means you accept the updated Terms.
The App allows you to create and store content such as skincare logs, product details, notes, and photos (“User Content”).
You agree not to misuse the App. For example, you will not:

The App and content provided by us are owned by HolliCycle or our licensors and protected by law. We grant you a limited, personal, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
The App may interact with third-party services (e.g., operating system features or external websites opened in a browser). We are not responsible for third-party services.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, HolliCycle Team will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill arising out of or related to your use of the App.
To the maximum extent permitted by law, our total liability for all claims related to the App will not exceed the greater of (a) the amount you paid us for the App in the 12 months before the event giving rise to the claim or (b) USD $100.
You agree to defend, indemnify, and hold harmless HolliCycle Team from claims and expenses arising out of your use of the App, your User Content, or your violation of these Terms or applicable law.
You may stop using the App at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk, or if required by law. Provisions that should survive will survive.
Governing Law: These Terms are governed by the laws of our principal place of business, without regard to conflict of laws principles.
Arbitration: Any dispute arising out of or relating to these Terms or the App will be resolved by binding arbitration, except either party may seek injunctive or equitable relief in court for intellectual property or unauthorized access matters.
The arbitrator’s decision will be final and binding. Each party bears its own legal fees unless the arbitrator awards otherwise under applicable law.
